Overview
AirAdvisor is seeking a highly skilled Litigation Lawyer specializing in consumer flight claims (typically via small claims procedure) to lead in-court collections in Italy. The role involves filing batches of court cases to recover compensation and/or reimbursement of out-of-pocket expenses incurred by passengers and/or recover ticket refunds. Pre-court collections are managed by a team of paralegals. The candidate must be free from conflicts of interest and able to litigate against different airlines. The company supports remote-first work with a global expansion focus.
Responsibilities
* Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction.
* Assist in establishing a law firm in Italy if feasible, including corporate structuring and registering foreign legal counsels where applicable.
* Conduct pre-court collections and out-of-court settlements.
* Prepare and file batches of approximately 200+ new claims monthly in Italian courts against various airlines to recover: (a) compensation under EU Regulation 261/2004 and/or Turkish SHY Regulation for delays, cancellations, and denied boarding; (b) reimbursement of out-of-pocket expenses under EU261/2004 and/or the Montreal Convention; (c) ticket refunds under applicable legal frameworks; (d) handle baggage-related claims under the Montreal Convention and/or Warsaw Convention; (e) respond to airline defenses and lead enforcement of judgments when needed; (f) engage in court-led settlement negotiations and represent AirAdvisor’s interests in favorable in-court settlements.
* Lead enforcement proceedings and coordinate with bailiffs or enforcement authorities as required.
* Maintain complete and accurate legal case files, ensuring compliance with Italian legal ethics and data protection regulations.
* Perform legal research and comparative analysis to develop best practices for managing recurring issues in airline and consumer rights litigation.
* Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and precedents to provide updated legal advice.
* Pursue legal remedies, including appeals when justified, and advocate for legislative changes if strategically feasible.
* Support optimization and automation of claims management workflows using legal tech, including AI-based tools, to improve efficiency and scale.
* Identify new civil claims opportunities viable under Italian law and with high-volume potential (e.g., certain financial disputes, labor-related claims, etc.).
* Conduct cross-jurisdictional legal research across EU and UK markets to adapt precedents for Italy in complex scenarios.
* Represent AirAdvisor in local media and coordinate with PR to raise public awareness of passenger rights; review content as needed.
* Advocate for passenger and consumer rights within the travel industry and promote fair treatment and legal protection for air travelers.
Qualifications
* A valid Attorney at Law license in Italy and professional liability insurance.
* A law degree from an accredited institution.
* Experience with small claims, consumer rights, or aviation law is a plus but not required.
* Knowledge of consumer protection laws and aviation regulations is a plus but not required.
* Proven track record of success in in-court collection.
* Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective strategies.
* Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations.
* Experience in automating and standardizing claims management processes to scale quickly.
* Conflict-free to litigate against different airlines.
