Overview
AirAdvisor, we are dedicated to ensuring air travelers receive the compensation they are entitled to for flight disruptions. We are seeking a highly skilled and dedicated Litigation Lawyer specializing in consumer flight claims to lead in-court collections and potentially assist in opening a boutique legal firm in Italy. Pre-court collections are managed by a team of paralegals. You will be responsible for filing batches of court cases to collect compensation and/or reimbursement of Out-of-Pocket Expenses (OPE) incurred by passengers and/or recover ticket refunds.
Company scope
AirAdvisor currently handles three types of airline claims: EU261 compensation for delays, cancellations, and denied boarding; and three types of baggage claims under the Montreal Convention: lost, delayed, and/or destroyed luggage. We operate in the EU, UK, and other international markets, with 21 languages and a plan to reach 1 million claims by the end of 2026.
Responsibilities
* Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction.
* If setting up a law firm in Italy were feasible, assist in this matter, including corporate structuring and registering relevant personnel on official lists.
* Pre-court collections and out-of-court settlements.
* Prepare and file batches of approx. 200+ legal new claims monthly in Italian courts against various airlines for (a) Compensation under EU Regulation 261/2004 and/or Turkish SHY Regulation, (b) Reimbursement of out-of-pocket expenses under EU261/2004 and/or the Montreal Convention, (c) Ticket refunds owed to passengers, (d) Handle baggage-related claims under Montreal or Warsaw Conventions.
* Respond comprehensively to airline defenses, lead enforcement of court judgments, and coordinate with enforcement authorities when necessary.
* Engage in court-led settlement negotiations and, where applicable, represent AirAdvisor’s interests in favorable in-court settlements.
* Maintain complete and accurate legal case files, ensuring compliance with Italian legal ethics, data protection regulations, and professional standards.
* Conduct legal research and comparative analysis to compile best practices for managing recurring issues in airline and consumer rights litigation.
* Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and judicial precedents to provide updated, authoritative legal advice and representation.
* Pursue legal remedies, including appeals, when warranted, and advocate for legislative changes where feasible.
* Support the optimization and automation of claims management workflows, leveraging legal technology solutions to improve efficiency and scalability.
* Identify and propose new civil claims opportunities viable under Italian law with low-value, high-volume litigation potential (e.g., certain civil disputes, labor law-related claims, etc.).
* Conduct cross-jurisdictional legal research across EU and UK markets to identify precedents that can be adapted for Italy.
* Represent AirAdvisor in local media and coordinate with PR for public awareness around court rulings or legal developments; review and vet content as needed to build local trust and authority.
* Advocate for passenger and consumer rights within the airline and travel industry.
Requirements
* A valid Attorney at Law license in Italy and professional liability insurance.
* A law degree from an accredited institution.
* Experience with small claims, consumer rights, or aviation law is a plus, but not required.
* Knowledge of relevant consumer protection laws and aviation regulations is a plus, but not required.
* Proven track record of success in in-court collection.
* Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective legal strategies.
* Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations.
* Experience in automating and standardizing claims management processes to scale up quickly.
* Ability to work independently, manage multiple projects, and maintain high standards of professional ethics.
