Overview
AirAdvisor seeks a Litigation Lawyer in Italy with an Attorney at Law license and authorization to practice in Italy to lead in-court collections for airline passenger claims. The role focuses on filing batches of court cases to recover compensation, reimbursement of out-of-pocket expenses, and ticket refunds related to EU261/2004 and Montreal Convention baggage claims. Pre-court collections are handled by a paralegal team. The candidate should be able to self-perform, maintain conflicts-free status, and pursue high-quality consumer rights advocacy in the airline industry.
Requirements
* A valid Attorney at Law license in Italy and professional liability insurance.
* A law degree from an accredited institution.
* Experience with small claims, consumer rights, or aviation law is a plus but not required.
* Knowledge of relevant consumer protection laws and aviation regulations is a plus but not required.
* Proven track record of success in in-court collection.
* Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective legal strategies.
* Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations.
* Experience in automating and standardizing claims management processes to scale up quickly.
Responsibilities
* Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction. If feasible, assist in establishing a law firm in Italy, including corporate structuring and related formalities.
* Pre-court collections and out-of-court settlements.
* Prepare and file batches of approximately 200+ new claims monthly in Italian courts against airlines to recover: a) EU Regulation 261/2004 compensation for delays, cancellations, and denied boarding; b) reimbursement of out-of-pocket expenses under EU261/2004 and Montreal Convention; c) ticket refunds; d) baggage-related claims under the Montreal Convention and/or Warsaw Convention.
* Respond to airline defenses with substantive, procedural, and jurisdictional arguments.
* Lead enforcement of court judgments and coordinate with enforcement authorities when necessary.
* Engage in court-led settlement negotiations and represent AirAdvisor’s interests in favorable in-court settlements where applicable.
* Maintain complete and accurate legal case files, ensuring compliance with Italian legal ethics, data protection regulations, and professional standards. Conduct legal research and analysis to manage recurring legal issues in airline and consumer rights litigation.
* Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and judicial precedents to provide updated legal advice and representation.
* Pursue legal remedies, including appeals, when warranted, and advocate for legislative changes where strategically feasible.
* Support optimization and automation of claims management workflows, leveraging legal technology solutions, including AI-based tools.
* Identify and propose new civil claims opportunities viable under Italian law, including potential cross-jurisdictional research across the EU and UK for applicable precedents.
* Represent AirAdvisor in local media as needed, coordinating with PR to highlight landmark rulings and legal developments.
* Review and vet content as needed to build local trust and authority.
* Advocate for passenger and consumer rights within the airline and travel industry.
* Assist with business development as appropriate within legal and regulatory boundaries.
